Personal finance media should be boring - Abnormal Returns ...

Russell: Well, why am I watching it?

George: Because it?s on TV.

Too many investors take to heart George Constanza?s idea that because something is on (financial) television they should pay attention to it. When the opposite is likely the case: the more something is discussed the more likely it is already well-discounted by the market.

Jeff Miller at A Dash of Insight in a recent post notes the many ways in which financial pundits make mistakes which investors can easily avoid. It is not necessarily a coincidence that the pundits financial television continues to put on the air gets things so wrong. This is large part because the media is not necessarily seeking the truth, rather they are seeking ratings. As Miller writes:

Truth is harder to sell than fear.

Barry Ritholtz at The Big Picture asked whether relative to the sequestration debate whom we should believe: the markets or the media? As Ritholtz notes both are prone to irrational behavior but for the media it is different. Ritholtz writes:

With Media, irrational behavior is a feature, not a bug. The goal is to attract a large audience that can be monetized with adverts. Hence, there is an incentive to emphasize the outrageous, the ridiculous, to create buzz and hype. An entire subspecialty dedicated to studying memes and viral events has arisen to capitalize on this. It is considered an advantage when media spirals into their regular fits of hype. From a business perspective, ?Irrationality? to organizations that sell audiences to advertisers, is quite a rational behavior.

Josh Brown at The Reformed Broker notes an even more salient point for investors. That is, what see in the media is not really what matters to investors. Brown calls it a ?big disconnect? and highlights ten reasons why this is the case. He writes:

The financial media is irrationally addicted to trading stories because they have urgency and they?re entertaining, even if ultimately unsatisfying to the 90 million Americans who are trying to figure out what to do with their wealth. There is a relentless focus on analyst research calls, upgrades and downgrades, economic data releases, merger and acquisition buzz, hedge fund activity etc. This is all highly interesting and I personally enjoy both consuming and creating this type of content as well. But it should not be the only thing on the web / airwaves. It is disproportionately dominant when compared to its actual utility for the majority of the audience. There is a huge content arbitrage opportunity here.

Moving from the purely financial, Seth Godin had a great post up talking about the media and how ?real-time news is neither.? Godin notes how the media?s desire to break news ever faster has decreased its utility for the viewer. In short, we can safely avoid the rush to judgment and sit back and wait to let history play out. He writes:

In the last ten years we?ve redefined breaking news from ?happened yesterday? to ?happened less than fifteen seconds ago.? The next order of magnitude will be prohibitively expensive and (most of the time) not particularly useful. Better, I think, to hustle in the other direction and figure out how to benefit from well-understood truth instead of fast and fresh rumor.

The best investors focus on ?well-understood truths.? I spent an entire chapter of my book on ?smarter media consumption.? So this is a topic close to my heart, therefore it is worth noting:

What should be clear from this is that the members of the financial media are not looking out for your best interests. Nor should we expect them to. In investing we talk about somebody having a fiduciary duty toward another person. This means the person with the fiduciary duty is legally obligated to act in your best interests. The members of the financial media have no such duty. They are there to entertain and by extension generate ratings, subscriptions, and page views.

In a certain respect, writing about personal finance, like investing itself, should be kind of boring. The principles that underlie sound personal finance practices don?t change all that much. For instance, there are only so many ways you can tell people to save more and spend less. The financial media is compelled to try and make things more interesting than they seem.

So if time spent on financial media is for most investors a waste of time, STOP DOING IT. As the old joke goes:

SMITH: Doctor, it hurts when I do?this.
DALE: Don?t?do?that.

Add "Minority Report"-like interface to your computer for $80

Did watching "Minority Report" make you fall in love with the idea of interacting with a computer by waving your hands around? Once a small gadget starts shipping on May 13, can do just that. You'll be able to control your Windows or Mac computer by wiggling your fingers, fidgeting with a pen, or otherwise moving your hands around.

The little gadget is called the Leap Motion Controller. Similar to existing 3-D motion-tracking systems ? such as Xbox Kinect, for example ? it captures your movements. The Leap's just significantly more precise, tracking the movements of both hands (and all ten fingers) at up to 290 frames per second. (The device's makers claim that it is even up to 200 times more sensitive than any existing motion-control technologies.) The fact thatit's only about 3 inches long doesn't exactly hurt its sales pitch either. It'll barely take up any space on your desk.

The Leap Motion Controller will support interactions across Windows 7, Windows 8, OS X 10.7 and 10.8. There will also be a variety of apps specifically designed with the Leap Motion Controller in mind. They will live in an app store Leap will operate, called Airspace. Some of the apps already expected include plug-ins for 3-D design software by Autodesk, Corel's Painter apps, various Disney games, "Cut the Rope" and more.

"I believe the Leap is the future of how people will interact with their devices,? Bill Warner, founder of Avid Technology and one of Leap Motion's investors, said in a press release when the company first announced its plans.

?What's previously been an expensive special effect in movies is now an affordable everyday reality, in full 3-D. With [the Leap Motion Controller], you use both hands and all 10 fingers to work within your computer's virtual environment just as easily as you do in the real world.?

Those who pre-order the Leap Motion Controller through either the Leap Motion website or the Best Buy website will see it ship on May 13. On May 19, the device will hit Best Buy stores. And despite all the promise of this little gadget, it will only set you back $80.

Grand jury decides no charges against New Jersey's "Tan Mom"

(Reuters) - The case of the deeply bronzed New Jersey woman known as "Tan Mom" appears destined to fade away. A grand jury declined to indict her on child endangerment charges, a prosecutor said on Tuesday.

Patricia Krentcil was arrested in April 2012 after her then 5-year-old daughter showed up at school with a sunburn and officials accused her of taking the child into a tanning booth.

At the time, the blonde mother's chocolate-brown hue testified to many hours spent under the intense ultraviolet light of a tanning bed or out in the sun soaking up rays.

New Jersey is among several states that have adopted regulations prohibiting anyone age 14 or under from tanning with using ultraviolet devices because of the risk of skin cancer.

A grand jury considering the case against Krentcil, 44, of Nutley, New Jersey, decided not to indict her on charges of endangering the welfare of a child, the Essex County prosecutor's office said on Tuesday.

"We presented all the available evidence in the case to the grand jury," said Assistant Essex County Prosecutor Gina Iosim.

"The grand jurors voted not to indict Mrs. Krentcil. ... We respect their decision," Iosim said.

Krentcil's attorney Natalia Diaz hailed the panel's decision, noting that the mother of could have faced a prison term of up to 10 years had she been convicted of the charge.

"The case was just basically ridiculous," Diaz said. "It's almost like a witch hunt."

The child, now 6, is fair-skinned and showed up at school with a sunburn after spending time outside on a sunny day, not in a tanning booth, Diaz said.

Krentcil, who is also "very, very fair skinned," said she frequented tanning booths because she wanted to look "nice and dark," Diaz said. But that is all in the past.

"She no longer tans like that," Diaz said.

    Actress Anne Hathaway has had an on-again/off-again relationship with a meat-free diet. but according to the most recent reports, she is currently a a vegetarian. <a href="http://www.realbollywood.com/2011/08/anne-hathaway-speaks-vegetarian-diet.html" target="_hplink">Realbollywood.com reported</a> the actress had trouble while in the UK in August. <a href="http://www.metro.co.uk/film/851230-anne-hathaway-theres-nothing-wrong-with-nudity-in-films" target="_hplink">In an interview with <em>Metro</em></a> in December 2010, Hathaway said: "I've actually been a commitment-shy vegetarian since I was about 12. And then I was sent a copy of Jonathan Safran Foer's Eating Animals. I read it and that was it for me in terms of being able to eat fish - which is a shame because I really enjoy the taste but I just can't support the way fish are farmed and caught." "I was a vegetarian in the womb, I was doing it before it was a trend," he joked. "My parents have been vegetarian for 40 years. They raised my sisters and I vegetarian, we had a dog - he was vegetarian." He added that even when he branched out as a teenager to other foods it just "didn't sit well" with him.

    Activist and strict vegan Daryl Hannah <a href="http://www.vegetariantimes.com/features/editors_picks/914" target="_hplink">told <em>Vegetarian Times</em></a> in 2010 she converted to vegetarianism at age 11 after bonding with a calf.     Primatologist, philanthropist, conservationist and vegetarian Jane Goodall <a href="http://vegetarian.procon.org/view.source.php?sourceID=010726" target="_hplink">said on Procon.org</a> she switched to a plant-based diet after learning about factory farms in the early 1970s after reading Peter Singer's Animal Liberation.     NASCAR driver Andy Lally fuels himself on a vegan diet. He made the switch two years ago, <a href="http://vegetarianstar.com/2011/07/13/andy-lally-races-on-vegan-fuel/" target="_hplink">according to Vegetarianstar.com.</a> The site writes Lally said: "If (people) were able to see the mistreatment and what goes on and see what shows up to them in a nice shiny package."     Ford: 450 jobs to Brook Park plant

    BROOK PARK, Ohio - Ford has announced a $200 million investment at its factory in Brook Park so it can make the four-cylinder, 2-Liter "EcoBoost" engine. It also means 450 new jobs at the factory by 2014.

    The factory now makes two larger six-cylinder engines.

    Ford announced earlier this week that it was moving production of the popular small engine from Spain to Brook Park as sales of four-cylinder motors rise.

    Ford and other carmakers are looking to four-cylinder turbocharged motors to help meet stricter U.S. fuel economy rules. And as pump prices again surge toward $4 a gallon, the engines satisfy driver demand for better mileage. In the U.S., new vehicles will have to average 54.5 miles per gallon by 2025, twice the roughly 27 mpg they get today

    Ford's 2-Liter EcoBoost engine now is manufactured in Valencia, Spain, and shipped to the U.S., where its sales are growing. More customers are choosing smaller engines as Ford and others offer them on more models. The engines get better gas mileage than six-cylinder motors. And they have turbochargers, which give them more power when needed.

    Major methane release is almost inevitable

    We are on the cusp of a tipping point in the climate. If the global climate warms another few tenths of a degree, a large expanse of the Siberian permafrost will start to melt uncontrollably. The result: a significant amount of extra greenhouse gases released into the atmosphere, and a threat ? ironically ? to the infrastructure that carries natural gas from Russia to Europe.

    The Arctic is warming faster than the rest of the planet, and climatologists have long warned that this will cause positive feedbacks that will speed up climate change further. The region is home to enormous stores of organic carbon, mostly in the form of permafrost soils and icy clathrates that trap methane ? a powerful greenhouse gas that could escape into the atmosphere.

    The Siberian permafrost is a particular danger. A large region called the Yedoma could undergo runaway decomposition once it starts to melt, because microbes in the soil would eat the carbon and produce heat, melting more soil and releasing ever more greenhouse gases. In short, the melting of Yedoma is a tipping point: once it starts, there may be no stopping it.

    For the first time, we have an indication of when this could start happening. Anton Vaks of the University of Oxford in the UK and colleagues have reconstructed the history of the Siberian permafrost going back 500,000 years. We already know how global temperatures have risen and fallen as ice sheets have advanced and retreated, so Vaks's team's record of changing permafrost gives an indication of how sensitive it is to changing temperatures.

    Stalagmite record

    But there is no direct record of how the permafrost has changed, so Vaks had to find an indirect method. His team visited six caves that run along a south-north line, with the two southernmost ones being under the Gobi desert. Further north, three caves sit beneath a landscape of sporadic patches of permafrost, and the northernmost cave is right at the edge of Siberia's continuous permafrost zone.

    The team focused on the 500,000-year history of stalagmites and similar rock formations in the caves. "Stalagmites only grow when water flows into caves," Vaks says. "It cannot happen when the soil is frozen." The team used radiometric dating to determine how old the stalagmites were. By building up a record of when they grew, Vaks could figure out when the ground above the caves was frozen and when it wasn't.

    As expected, in most of the caves, stalagmites formed during every warm interglacial period as the patchy permafrost melted overhead.

    But it took a particularly warm interglacial, from 424,000 and 374,000 years ago, for the stalagmites in the northernmost cave to grow ? suggesting the continuous permafrost overhead melted just once in the last 500,000 years.

    At the time, global temperatures were 1.5??C warmer than they have been in the last 10,000 years. In other words, today's permafrost is likely to become vulnerable when we hit 1.5??C of global warming, says Vaks.

    "Up until this point, we didn't have direct evidence of how this happened in past warming periods," says Ted Schuur of the University of Florida in Gainesville.

    It will be very hard to stop the permafrost degrading as a warming of 1.5??C is not far off. Between 1850 and 2005, global temperatures rose 0.8??C, according to the 2007 report of the Intergovernmental Panel on Climate Change. Even if humanity stopped emitting greenhouse gases tomorrow, temperatures would rise another 0.2??C over the next 20 years. That would leave a window of 0.5??C ? but in fact our emissions are increasing. What's more, new fossil fuel power stations commit us to several decades of emissions.

    Soggy permafrost

    What are the consequences? The greatest concern, says Tim Lenton of the University of Exeter in the UK, is the regional landscape. Buildings and infrastructure are often built on hard permafrost, and will start subsiding. "Ice roads won't exist any more."

    The increasingly soggy permafrost will also threaten the pipelines that transport Russian gas to Europe. "The maintenance and upkeep of that infrastructure is going to cost a lot more," says Schuur.

    As for the methane that could be released into the atmosphere, Schuur estimates that emissions will be equivalent to between 160 and 290 billion tonnes of carbon dioxide.

    That sounds like a lot, but is little compared to the vast amount humans are likely to emit, says Lenton. "The signal's going to be swamped by fossil fuel [emissions]."

    He says the dangers of the permafrost greenhouse gases have been overhyped, particularly as much of the methane will be converted to carbon dioxide by microbes in the soil, leading to a slower warming effect.

    Schurr agrees with Lenton that the methane emissions are "not a runaway effect but an additional source that is not accounted in current climate models".

    The Handful of Countries Without a Minimum Wage

    In a surprising move, President Obama proposed during the State of the Union address to increasing the federal minimum wage to $9 an hour. A perpetually controversial issue, the minimum wage remains a flashpoint between progressives and conservatives, with proponents saying it keeps full-time workers out of poverty and opponents arguing it increases unemployment.

    As the map above shows, only a handful of countries lack minimum wage laws: Congo, Kenya, Somalia, Pakistan, among a few others. Most countries have a minimum-wage law or agreement. In many cases, those laws guarantee a minimum wage only to workers in certain industries or locations. And many countries with minimum-wage laws struggle to enforce them.

    NY Jets quarterback Tebow cancels controversial church appearance

    (Reuters) - New York Jets quarterback Tim Tebow, a devout Christian, has canceled an appearance at the Dallas mega-church led by a prominent pastor who has sparked controversy over remarks he made from the pulpit about gays and other religions.

    Tebow, 25, who famously kneels in prayer on the football field in a move that has come to be known as "Tebowing", called off his April 28 appearance in a series of Twitter messages on Thursday.

    "While I was looking forward to sharing a message of hope and Christ's unconditional love with the faithful members of the historic First Baptist Church of Dallas in April, due to new information that has been brought to my attention, I have decided to cancel my upcoming appearance," he said.

    The First Baptist Church in Dallas, which had invited Tebow to celebrate the opening of its $130 million campus, is led by Robert Jeffress, a TV evangelist who has criticized gays and other faiths, such as Islam and Mormonism.

    Tebow, whose parents are missionaries, called Jeffress on Wednesday evening and said he "needed to avoid controversy at this time, but would like to come to First Baptist Dallas to speak at a future date," according to a statement from the church.

    The church on Thursday blamed news media for having "grossly misrepresented" Jeffress' opinions and for putting pressure on Tebow.

    It said: "The reason for the recent media fire storm is not because the Word of God has changed, but because society has changed."

    Jeffress on Thursday softened past statements he has made criticizing the Roman Catholic Church, but defended his position on gays and lesbians.

    "I believe that homosexuality is a sin, just like adultery," Jeffress told CNN. "Sex should be between a man and a woman. God created sex. He knows how it works best," Jeffress said.

    Tebow was a first-round draft pick in 2010 and the first college sophomore to win the Heisman Trophy, according to his website. Tebow was traded by the Denver Broncos to the Jets, but saw little playing time during the 2012 season.

    A former middle school teacher has pleaded guilty to charges that she embezzled $433,000 from the Worcester County teachers? union.

    The Daily Times of Salisbury reports?that Denise Owens admitted she stole the money to finance her gambling addiction.

    Prosecutors say Owens visited casinos in Delaware more than 600 times over a 3-year period and gambled more than $1 million.

    The 58-year-old Owens apologized for her actions in court Tuesday, saying she knew she was wrong from the minute she started stealing. She said she was relieved to have been caught.

    4 dead, including gunman, in Calif. shooting spree

    TUSTIN, Calif. (AP) ? The early morning commute was just getting under way on suburban Orange County's network of freeways when Melvin Lee Edwards pulled up to a stop sign near a busy off-ramp.

    It was just after 5 a.m. and Edwards, 69, was on his way to work when, police say, a fleeing murder suspect forced him out of his BMW at gunpoint, marched him across the street and shot him three times from behind as horrified commuters watched.

    The shooting was the second of three murders in a trail of carnage early Tuesday that spanned 25 miles ? but lasted just an hour. The shooter, 20-year-old Ali Syed, killed a woman in the home he shared with his parents, killed two drivers during carjackings, injured two others and shot up cars on a busy freeway interchange before committing suicide as police closed in, authorities said.

    Syed, an unemployed part-time community college student, had no known motive and acted alone, said Tustin police Chief Scott Jordan. The first victim, a woman in her twenties, has not been identified and was not related to Syed, he said.

    The violence began at 4:45 a.m., when deputies responded to a call from Ladera Ranch, a sleepy inland town about 55 miles southeast of Los Angeles. They found the woman shot multiple times.

    Syed's parents were in the house at the time, fled the residence when shots were fired, and reported it, Jordan said.

    From Ladera Ranch, the gunman headed north and pulled off Interstate 5 in Tustin, about 20 miles away, with a flat tire, police said.

    A man who was waiting in a shopping center parking lot to carpool with his son saw Syed had a gun and tried to escape in his Cadillac, Jordan said. Syed ran after the car as it drove away and fired his shotgun through the back window, striking the driver in head but not killing him.

    The driver "noticed that he was loading his shotgun, so he simply gets back in his car and tries to escape," Jordan said. "He's driving through the parking lot trying to get away and the suspect is actually chasing him on foot, taking shots at him."

    Syed then crossed the street to a Mobil gas station, where he approached the driver of a pick-up who was filling his tank and asked for his keys, Jordan said.

    "He says something to the effect of, 'I've killed somebody. Today's my last day. I don't want to hurt you. Give me your keys,'" the police chief said. "He hands over the keys and he gets in the truck and leaves."

    Syed got back on the freeway, where he pulled to the side of the road at the busy I-5 and State Route 55 interchange and began firing at commuters, Jordan said.

    One driver was struck in the mouth and hand. He didn't have a cellphone, but was able to drive home and call police. Two other cars were hit but their drivers weren't injured, Jordan said.

    "All of this is happening so quickly," he said, estimating that Syed shot at drivers from the side of the freeway transition for about a minute.

    The shooter then exited the freeway in nearby Santa Ana but ran the curb and got his car stuck, authorities said.

    He approached Edwards, of Laguna Hills, who was on his way to his Santa Ana business. Syed shot Edwards three times, including in the back of the head and the back, Jordan said.

    Onlookers "tried to get away. They saw what was going on, they tried to get away and they called police," he said.

    Syed took Edwards' BMW and next popped up at the Micro Center, a Tustin business, where he shot and killed construction worker Jeremy Lewis, 26, of Fullerton. Lewis' co-worker rushed to intervene and was shot in the arm, Jordan said.

    Syed took the second construction worker's utility truck and fled to Orange, this time with California Highway Patrol officers in pursuit. He jumped from the moving utility truck at an intersection in Orange, about five miles away, and shot himself in the head, Jordan said.

    "There really wasn't a confrontation at the very end," he said. "It happened so quickly."

    A shotgun was recovered at the scene and is believed to be the only weapon used.

    A message left at Syed's parents' home wasn't immediately returned on Tuesday.

    Official Sony PlayStation 4 second screen app coming to iPhone and iPad

    Official Sony PlayStation 4 second screen app coming to iPhone and iPadSony held a press conference yesterday to announce its upcoming next generation PlayStation 4 console. One of the additional things that Sony also announced was a new app that would allow an iPhone, iPad or iPod touch to be used as a second screen device with the PS4 console.

    A new application from SCE called ?PlayStation?App? will enable iPhone, iPad, and Android based smartphones and tablets to become second screens. Once installed on these devices, users can, for example, see maps on their second screens when playing an adventure game, purchase PS4 games while away from home and download it directly to the console at home, or remotely watch other gamers playing on their devices.

    The possibility for second screen usage is pretty much endless and it is great to see Sony preparing to offer this for iPhone, iPad and iPod touch users. Microsoft already offers a second screen app for its Xbox 360 called SmartGlass that allows users to remotely control the gaming console, view related content, type out messages, and otherwise complement everything you?d normally just do with the hardware controller. Hopefully with the PlayStation 4 and the new Xbox, we will see a lot more uses for second screen apps on the iPhone and iPad.

    Autopsy confirms Mindy McCready's death as suicide

    (AP) ? Authorities in Arkansas say preliminary autopsy results confirm country music singer Mindy McCready's death was a suicide.

    The Cleburne County sheriff said in a statement Wednesday that preliminary autopsy results from Arkansas' state crime lab show McCready's death was a suicide from a single gunshot wound to the head.

    Investigators have said McCready apparently shot and killed her late boyfriend's dog before she turned the gun on herself Sunday at her home in Heber Springs, Ark. Authorities found McCready's body and the dog on the front porch where her longtime boyfriend, musician David Wilson, died last month of a gunshot wound to the head.

    Authorities are investigating Wilson's death as a suicide but they haven't determined an official cause of death yet.

    At least six people died and 23 injured when an overcrowded bus fell into a river after overturning in China's Henan province Wednesday, Xinhua reported.

    The accident occurred in the morning in Luanchuan county, some 300 km from provincial capital of Zhengzhou, the traffic police said.

    The bus, with 34 people on board, had a loading capacity of 19, sources said.

    Omega-3 lipid emulsions markedly protect brain after stroke in mouse study

    Feb. 20, 2013 ? Triglyceride lipid emulsions rich in an omega-3 fatty acid injected within a few hours of an ischemic stroke can decrease the amount of damaged brain tissue by 50 percent or more in mice, reports a new study by researchers at Columbia University Medical Center.

    The results suggest that the emulsions may be able to reduce some of the long-term neurological and behavioral problems seen in human survivors of neonatal stroke and possibly of adult stroke, as well. The findings were published in the journal PLoS One.

    Currently, clot-busting tPA (recombinant tissue-type plasminogen activator) is the only treatment shown to improve recovery from ischemic stroke. If administered soon after stroke onset, the drug can restore blood flow to the brain but may not prevent injured, but potentially salvageable, neurons from dying.

    Drugs with neuroprotective qualities that can prevent the death of brain cells damaged by stroke are needed, but even after 30 years of research and more than 1000 agents tested in animals, no neuroprotectant has been found effective in people.

    Omega-3 fatty acids may have more potential as neuroprotectants because they affect multiple biochemical processes in the brain that are disturbed by stroke, said the study's senior author, Richard Deckelbaum, MD, director of the Institute of Human Nutrition at Columbia's College of Physicians & Surgeons. "The findings also may be applicable to other causes of ischemic brain injury in newborns and adults," added co-investigator Vadim S. Ten, MD, PhD, an associate professor of pediatrics from the Department of Pediatrics at Columbia.

    The effects of the omega-3 fatty acids include increasing the production of natural neuroprotectants in the brain, reducing inflammation and cell death, and activating genes that may protect brain cells. Omega-3 fatty acids also markedly reduce the release of harmful oxidants into the brain after stroke. "In most clinical trials in the past, the compounds tested affected only one pathway. Omega-3 fatty acids, in contrast, are very bioactive molecules that target multiple mechanisms involved in brain death after stroke," Dr. Deckelbaum said.

    The study revealed that an emulsion containing only DHA (docosahexaenoic acid), but not EPA (eicosapentaenoic acid), in a triglyceride molecule reduced the area of dead brain tissue by about 50 percent or more even when administered up to two hours after the stroke. Dr. Deckelbaum noted, "Since mice have a much faster metabolism than humans, longer windows of time for therapeutic effect after stroke are likely in humans." Eight weeks after the stroke, much of the "saved" mouse brain tissue was still healthy, and no toxic effects were detected.

    Studies are currently under way to test the emulsion in older mice and in mice with different types of stroke. The researchers are also conducting additional studies to identify more precisely how the omega-3 emulsion works and to optimize the emulsion in order to improve functional recovery after stroke.

    After animal studies on dosages and timing, and if the emulsions continue to show promising results, Dr. Deckelbaum said, clinical trials could begin quickly, as such emulsions have already been shown to be safe in people. Similar emulsions are used in European ICUs for nutrition support, and in the US they have been found to be safe when tested in babies for their nutritive and anti-inflammatory effects.

    The title of the paper is "n-3 Fatty Acid Rich Triglyceride Emulsions are Neuroprotective after Cerebral Hypoxic-Ischemic Injury in Neonatal Mice." The other contributors are Jill J. Williams, Korapat Mayurasakorn, Susan J. Vannucci (Weill Cornell); Christopher Mastropietro (Wayne State); Nicolas G. Bazan (Louisiana State); and Vadim S. Ten CUMC).

    The study was supported by the National Institutes of Health (RO1 HL040404, RO1 NS056146, and RO1 NS046741).

    A U.S. patent application filed by Columbia University and naming RD as an inventor, for the therapeutic use of omega-3 diglyceride emulsions, has been allowed by the U.S. Patent and Trademark Office.

    Capitol Confidential ? NYSUT will file legal challenge to tax cap today

    The state?s teachers union will file a legal challenge to the two-percent cap on property tax increases, contending the 2011 law ?locks in and perpetuates funding inequities between affluent and low-wealth school districts.?

    ?We believe very strongly in the principle that every student, no matter where they live or go to school, should have the opportunity to receive a quality public education,? said NYSUT President Dick Iannuzzi said in a statement. ?In challenging the constitutionality of the tax cap, we are fighting for that principle, just as we are fighting for the democratic principles of ?one person, one vote? and for the right of citizens, through local control of their schools, to determine for themselves how much they want to spend on their own community?s schools.?

    NYSUT lawyers plan to file their suit in Supreme Court in Albany County later this morning, a union aide said. Officials there lobbied against the tax cap when it was proposed by Gov. Andrew Cuomo, a Democrat, as well as earlier iterations of the legislation backed by Republicans and Democrats alike.

    Cuomo has lauded the cap, which forces school districts to win the support of 60 percent of voters if they increase the amount of their budget that comes from property taxes by more than two percent between school years. The measure also applies to municipal entities like counties and towns, but their 60 percent ?override? can come in a vote of elected officials.

    NYSUT?s legal action has been long rumored, and Cuomo has said he stands by the law, which has kept tax increases in check. He also says the cap is designed to set a benchmark for budget discussions, and direct public discourse away from large tax increases and toward talk of sharing services or cutting spending.

    ?If you think you?re going to come to Albany to raise taxes, forget it. Stay home,? Cuomo?s top aide, Larry Schwartz, told legislators who ran against the cap.

    NYSUT?s suit will challenge the law on seven grounds, including a charge that the cap prevents poorer districts from raising the resources they need to provide a sound, basic education mandated by the State Constitution. NYSUT also alleges that the 60-percent threshold should be struck down because it contradicts legal cases setting a one-man, one-vote standard of representation.

    A list of NYSUT?s seven causes of action is below. I?ll update with legal papers once they?re filed:

    First Cause: The state Constitution guarantees all schoolchildren the right to a sound, basic education ? the foundation of the Campaign for Fiscal Equity case. It also guarantees that school boards and voters can provide enhanced educational opportunities beyond the minimum and can address inequality through local control of spending. The tax cap unconstitutionally deprives students of that right by limiting the ability of school districts and taxpayers to address funding inequities. With its arbitrary tax cap, the state has locked in existing funding disparities between school districts by limiting the ability of districts and their taxpayers to address these inequities by exercising ?substantial local control.?

    Second Cause: Funding disparities between school districts exist because of differences in assessed property value from district to district. The Court of Appeals has recognized the state Constitution guarantees the ability of voters to set the levels of taxation properly to meet the needs of their school districts ? the concept of ?substantial local control.? The Court of Appeals has held that local control is the ?only rational basis? underpinning New York?s inequitable school finance system. The tax cap unconstitutionally strips away the ability of school districts and their taxpayers to exercise local control and address funding deficiencies.

    Third Cause: The right of school districts and voters to provide educational opportunity to school children is a liberty interest protected by the New York and U.S. constitutions. The tax cap infringes upon this liberty interest, and therefore denies equal protection of the law, by allowing voters in districts with greater taxable wealth to raise more revenue than those in low wealth districts.
    Fourth Cause: The tax cap violates the equal protection clauses of the state and U.S. constitutions by treating school districts and school district voters unequally from local government voters and non-education funding proposals. The suit notes most towns, villages and cities are comprised of a supervisor or mayor, and four council members or trustees. Thus, the overwhelming majority of non-education local governments can exceed the tax cap with a 3-2 vote that satisfies the supermajority requirement mathematically, but in reality is nothing more than a mere simple majority. Yet, adopting a school budget exceeding the tax cap requires a 60 percent supermajority of all voters.

    Fifth Cause: The tax cap?s requirement of a 60 percent supermajority is undemocratic and violates the one-man, one-vote protection of both the state and federal constitutions. Under the tax cap, a voter who casts a ballot in favor of exceeding the tax cap has only two-thirds the voting power of a voter who votes against the proposal.

    Sixth Cause: The tax cap violates voters? right to equal protection under the law by diminishing their voting power based on their desire to increase education funding. The 60 percent supermajority requirement classifies and treats unequally voters who support ? and would benefit from ? increased education funding. The votes of those who favor exceeding the tax cap are given two-thirds the weight of those who oppose exceeding the cap, violating equal protection under the law.

    Seventh Cause: Voting is free expression protected by the state constitution and First Amendment to the U.S. Constitution. When a school district proposes a cap-exceeding budget, the tax cap requires the district to include on the ballot a notice that is not neutral and is meant to discourage voters from approving a proposal to exceed the cap. In addition, the tax cap imposes adverse funding consequences where super majorities are not achieved in two votes. This ?poison pill? has a chilling effect on the free expression and voting rights of taxpayers who wish to increase school funding above the tax cap.
